More ambushes on South Kivu's main roads (July, 17,2001 6pm) NO 95 04 juillet 2001

Two member of the security service of the RCD - the rebel movment in control of South Kivu - killed in ambushes on Mugogo and Kaziba roads.

Around 9 pm of Tuesday, 19 June, 2001 Mr. Kasende Ngoyi, a soldier of the RCD, the rebel faction in control of the eastern part of the Congo, posted at Kaziba in the District of Walungu was killed by unidentified armed men. The killing of Mr. Ngoyi occurred on the main road linking Kaziba to Bukavu at the place known as 'Kalongolerwa' around the Mushenyi/Ngweshe area.

Three days before this incident, Mr. Desy Musinderi, a member of the local police (Police Nationale Congolaise) who lived in Gihamba avenue in the Ndendere area of the town of Bukavu was shot dead by armed men thought to belong to the notorious interahamwe militia. The killing of Mr. Musinderi occurred on the road leading to Mugogo, not far from the Baptist local church of Musakambo in the Kamisimbi-Ngweshe area.

According to our sources, the first victim, Mr. Kasende Ngoyi, was killed while patrolling the Mushenyi area. The incident that lead to his death involved a Mistubishi Fuso truck bearing the plate number IT 5047. The car belonged to Mr. Kasende, a different person bearing the same name as the victim. The car on its usual jounrney from Bukavu to Kaziba when it was attacked by a dozen of armed men. At the time of this attack the truck was also carrying other passengers in addition to three soldiers. One of the attackers wearing a mask emerged from the bush and ordered the driver of the car to stop. The agents of the rebel movement, RCD, who were on board the vehicle, ordered the driver not to stop. Following the refusal by the driver to stop the car, the armed men opened fire on the vehicle. Three bullets reached the car. Two broke the windscreen and another broke one of the car' mirrors. Fortunately no one was seriously injured or hurt. However, five persons got minor injuries, including one soldier who was hurt on his big finger. One old woman was hurt on the shoulder and Mr. Nkulwe Nalunva, a member of the 'local defense', the militia created around several villages by the RCD was injured as a result of his falling off the car. The driver of the car was also hurt.

Alarmed by the gunfire, soldiers who were patrolling in the surrounding areas arrived on the scene. Following a short exchange of fire between the attackers of the truck and the soldiers, Mr.Kasende Ngoyi was hurt by two bullets, one in his chest and another in the neck. The attackers then stripped the dead soldiers of his clothes and took his gun before disappearing in the bush again.

Following this incident, on June 20, 2001, the car of the British charity Save the Children was used by the local authorities to take the body of the dead soldier to the local cemetery of Ngula-Kaziba.

With regard to the second case, Mr. Desy, the victim, was on his way back from a mission in the Mugogo-Ngweshe area. He was together with his commander and the coordinator of the local car traffic. They all were on board a mini bus, when they were ordered to stop by the attackers. Mr. Desy, who was in his military uniform was immediately shot dead by the attackers, who also looted most of the belonging of the people who was on board the mini bus. The body of Mr. Desy was only found the following day in the tea plantation known as Irabata.

Heritiers de la Justice continues to denounce this type of incidents have been taking place in several places such as Uvira, Fizi, Kalehe and Kabare. Heritiers de la Justice continue also to call on all parties to the Congolese conflict to show restraint and respect for human life.
